For the record, you don't have to place a copyright notice on an original work for the copyright to be in place. That's merely a formality. Also, "prior art" has nothing to do with copyright and everything to do with patents.

Unless vlad took the photo himself (on a lsef timer) he doesn't own the copyright - the person who took the photo does, so you can sit pretty till the actual holder complains....

Model release not necessary, otherwise you wouldn't be able to take pictures anywhere. If someone consents to have their photo taken and doesn't impose any conditions at the time - tough!
Model releases are formalities so that she can't say she imposed any conditions when the photo was taken.
